International Data Transfers

GPU Resource is based in the United States. Data from EU, EEA, or UK visitors is transferred to and processed in the US. We rely on Standard Contractual Clauses (SCCs), adequacy decisions, and the EU-U.S. Data Privacy Framework where applicable through our processors. Data Retention

  • Active account data: Retained for the duration of your account plus 2 years after account closure or last meaningful activity
  • Prospect and contact data: Up to 3 years from last meaningful engagement
  • Tool usage and query data: Retained in anonymized or aggregated form for platform improvement; identifiable records retained for up to 2 years
  • Email correspondence: 3 years from last communication
  • Analytics data: Per Google Analytics defaults, up to 14 months for user-level data
  • Financial and contract records: 7 years as required by applicable law

Your Rights

EU and EEA Residents (GDPR)

You have the rights of Access, Rectification, Erasure, Restriction, Data Portability, Objection (including to direct marketing), and Withdrawal of Consent. To exercise any right, email us at the contact in Section 14 with the subject line “GDPR Data Request.” We will respond within 30 days. You also have the right to lodge a complaint with your national supervisory authority.

California Residents (CCPA/CPRA)

You have the rights to Know, Delete, Correct, and Opt-Out of Sale or Sharing of personal information. We do not sell or share personal information for cross-context behavioral advertising. You will not be discriminated against for exercising your rights.

B2B Context Note: The CCPA includes a partial exemption for personal information collected in a business-to-business context. Much of the data we collect qualifies under this exemption. We honor the rights above regardless. To submit a California privacy request, email us with “California Privacy Request” in the subject line. We will respond within 45 days.

Data Security

We implement TLS/SSL encryption for data in transit, access controls limiting data to authorized personnel, and use security-certified SaaS providers. Paid or subscription-gated features employ additional authentication controls. No transmission over the internet is 100% secure. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of GPUResource.com (the “Site”) and all tools, data, content, and services offered by Duplais Group LLC, doing business as GPU Resource (“we,” “us,” or “our”).

By accessing the Site, creating an account, using any tool or data resource, or subscribing to any service, you agree to be bound by these Terms. If you do not agree, do not use the Site or our services. If you are accepting on behalf of a business entity, you represent that you have authority to bind that entity.

Who May Use the Site

The Site is intended for business professionals and organizations in the ITAD, IT reseller, data center, and enterprise technology industries. It is not directed at consumers acting in a personal capacity. You must be at least 18 years of age and authorized to act on behalf of any business you represent.

Through the Site, GPU Resource offers or facilitates the following, which may evolve over time:

  • Market Analysis & Intelligence — reports, commentary, and analytical content covering GPU supply chains, secondary market trends, and ITAD industry dynamics
  • Interactive Tools & Resources — pricing calculators, valuation tools, benchmarking resources, data dashboards, and other interactive analytical features available through the Site
  • Technology Resources — educational content, guides, and reference materials for ITAD operators, IT resellers, and enterprise technology professionals
  • Subscriptions & Data Access — tiered access plans providing enhanced data, alerts, or platform features, governed by separate subscription terms where applicable
  • Additional Tools & Features — any other tools, calculators, dashboards, or resources made available through the Site from time to time

Where paid subscription or data access plans exist, additional terms specific to those plans apply and are incorporated by reference. In the event of conflict between these Terms and a specific subscription agreement, the subscription agreement controls.

All pricing data, market analysis, valuation outputs, and tool results provided through the Site are offered for informational and reference purposes only. GPU Resource makes no representation or warranty regarding the accuracy, completeness, timeliness, or fitness for any particular purpose of any data or tool output. Specifically:

  • Pricing data and FMV references are market estimates based on available data sources and methodologies — they do not constitute a formal appraisal, certified valuation, or guarantee of market value
  • Secondary market prices fluctuate rapidly — data may not reflect real-time conditions at the moment of use
  • Tool outputs should not be used as the sole basis for purchasing, selling, pricing, or financial decisions involving GPU or related hardware assets
  • GPU Resource is not a broker, dealer, auction house, or licensed appraiser — nothing on the Site constitutes an offer to buy or sell any asset
GPU Resource strongly recommends validating all pricing data and tool outputs against current market conditions, your own operational knowledge, and where appropriate, qualified professional advice before making material business decisions.

By using any pricing tool, data resource, or analytical feature on the Site, you acknowledge and accept these limitations.

Accounts & Access

Certain features of the Site may require account registration. You agree to provide accurate and complete information when creating an account and to keep your credentials secure. You are responsible for all activity that occurs under your account. GPU Resource reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the platform or its data.

Access to premium or subscription-gated features is subject to payment of applicable fees and compliance with any additional subscription terms. GPU Resource reserves the right to modify, suspend, or discontinue any feature or access tier with reasonable notice.

Intellectual Property

All content on the Site — including pricing data compilations, market analysis, tool methodologies, algorithms, dashboards, reports, branding, and proprietary data models — is the exclusive property of Duplais Group LLC dba GPU Resource or its licensed data providers, protected by applicable copyright, database rights, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site and its content for your internal business purposes. You may not:

  • Reproduce, redistribute, republish, or resell any pricing data, analysis, or tool output without prior written permission
  • Scrape, crawl, or extract data from the Site by automated means, including bots, spiders, or data harvesting tools
  • Use our data, tools, or methodologies to build a competing product or service
  • Remove or obscure any copyright, trademark, or proprietary notices from content accessed through the Site
  • Share account credentials or provide unauthorized third-party access to subscription-gated features

Prohibited Use

By registering an account or submitting your contact information through the Site, you acknowledge that GPU Resource may contact you regarding platform updates, pricing alerts, market reports, and related services. All marketing emails include an unsubscribe mechanism. You may opt out at any time by clicking unsubscribe in any email or by contacting us at the details in Section 16. Transactional and account-related communications may continue after a marketing opt-out.

THE SITE, ALL PRICING DATA, TOOLS, ANALYSIS, AND CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. GPU RESOURCE EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, TIMELINESS, AND NON-INFRINGEMENT. NO PRICING DATA OR TOOL OUTPUT CONSTITUTES A CERTIFIED VALUATION, FINANCIAL ADVICE, OR PROFESSIONAL APPRAISAL. GPU RESOURCE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GPU RESOURCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE, ANY PRICING DATA, TOOL OUTPUT, OR MARKET ANALYSIS, INCLUDING LOSS OF PROFITS, BUSINESS OPPORTUNITIES, OR DATA — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATED TO THE SITE EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO GPU RESOURCE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100.00) WHERE NO PAYMENT HAS BEEN MADE, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations; in such cases our liability is limited to the greatest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Duplais Group LLC dba GPU Resource and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses including reasonable attorneys’ fees arising out of your use of the Site, your violation of these Terms, your misuse of any pricing data or tool output, or your submission of false or unauthorized information through the Site.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions. Disputes shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in San Diego, California, on an individual basis. You waive any right to participate in a class action. Either party may seek injunctive relief in a court of competent jurisdiction in San Diego County to protect intellectual property rights or prevent irreparable harm.

Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised “Last Updated” date. Registered users will be notified of material changes by email where practicable. Your continued use of the Site after any change constitutes acceptance of the revised Terms.

Severability and Entire Agreement

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in full force. These Terms, together with our Privacy Policy and any applicable subscription agreement, constitute the entire agreement between you and GPU Resource regarding use of the Site.
